Gatherise provides an online platform that enables individuals to create, sign, and share petitions and campaigns. By creating or signing a petition, or otherwise using Gatherise, you agree to the following Terms of Service:
1. Nature of the Platform
- Gatherise is a neutral platform. It serves only as a communication and presentation tool between petition authors and supporters.
- The legal responsibility for petition content, accuracy of claims, and follow-up actions lies only with the petition authors.
- Gatherise does not endorse, verify, or guarantee the success of any petition.
- Gatherise does not allow content that includes personal insults, defamation, hate speech, harassment, or violence.
2. Eligibility
- You must be at least 13 years old to use Gatherise.
- By using Gatherise, you represent that you have the legal capacity to agree to these Terms.
3. Petition Content & Moderation
- Gatherise reserves the right to remove or restrict petitions that violate these Terms or applicable law.
- Once a petition is published and has received signatures, the petition text cannot be edited. Authors may update campaign descriptions separately.
- Petitions that contain calls for violence, discrimination, harassment, or misinformation are strictly prohibited.
4. User Conduct
You agree not to:
- impersonate others or misrepresent your identity,
- use Gatherise for spam, commercial solicitation, or advertising,
- upload viruses, malware, or harmful code,
- infringe on intellectual property rights,
- use automated tools (bots, scripts) to sign or manipulate petitions.
5. Signatures & User Authenticity
- A “signature” on Gatherise refers to information submitted by users to express support for a petition.
- Signatures are a measure of public opinion and have no legal binding effect.
- Each user is responsible for ensuring their provided contact details (such as email or phone number) are valid and belong to them.
- Signing on behalf of others, using fake identities, or automated signing (bots, scripts) is strictly prohibited. Gatherise may suspend petitions that show excessive suspicious activity.
6. Public Visibility & Signature Privacy
- Information provided by petition authors (such as name and petition text) will be displayed publicly.
- For signers, the name and optional fields they choose to share may be displayed publicly on the petition page.
- Private information such as email addresses and phone numbers is never displayed.
- Gatherise may contact petition authors or signers to verify authenticity of participation.
7. Intellectual Property
- Petition authors retain ownership of their petition content but grant Gatherise a worldwide, non-exclusive, royalty-free license to display, distribute, and promote their petition within the platform and related channels.
- Gatherise owns all rights to its trademarks, branding, software, and design. Users may not copy, reverse-engineer, or misuse Gatherise’s intellectual property.
8. Independence & Neutrality
- Gatherise is not affiliated with any government, political party, or organization.
- Petitions are managed independently by users, and Gatherise’s role is limited to providing technical infrastructure.
9. Donations & Payments
- Supportive payments or donations made through Gatherise are non-refundable.
- If a petition ends (whether by reaching its deadline or by suspension), any funds remain with Gatherise as platform support.
10. Media & Promotion
- Gatherise may choose to feature or share petitions on its own media channels at its discretion.
- Publication in Gatherise’s social media channels depends on editorial priorities and may be delayed or limited.
11. Termination & Suspension
- Gatherise may suspend or terminate user accounts, petitions, or access to the platform if these Terms are violated, or if required by law.
12. Disclaimer of Warranties
- Gatherise does not guarantee uninterrupted access, error-free operation, or the success of any petition.
13. Limitation of Liability
- Gatherise is not liable for any indirect, incidental, or consequential damages arising from the use of the platform.
- Petition authors are only responsible for their content and any resulting disputes.
14. Governing Law & Jurisdiction
- These Terms are governed by the laws of the EU (European Union).
- Any disputes shall be resolved exclusively in the courts of the EU.
15. Updates to Terms
- These Terms may be updated from time to time to reflect legal, operational, or technical changes.
- Updates will be published on this page, and significant changes will be communicated via official Gatherise channels.
